Judge says man who raped woman outside Canberra nightclub treated her like ‘live pornography’, jails him for three years

A man who raped a woman and labelled her body with permanent marker has been sentenced to three years in jail.

Marquis Monte Rex Mack, 22, was convicted of three charges, including two counts of raping a woman, at a car park opposite the Canberra nightclub Hopscotch in 2021.

The ACT Supreme Court was told Mack met his victim at the bar earlier in the night, before they left the venue to go to a nearby alcove.

It’s there Mack, who also went by “Kees”, asked the woman for sex and proceeded to film four intimate videos of the victim without her consent, the court heard.

He also wrote the word “Kees” on the woman using permanent marker, with an arrow pointing to her genitals, along with “Kees was here 12/12/21 1:39am” and “Keys is daddy”. 

The court heard he also wrote his mobile phone number and handles for his social media accounts on the victim, before pausing to film her and threatening to show his friends.

The woman protested, asking “what the f*** are you doing?” to which he replied: “oh trust me. It’s not going anywhere”.

The woman asked him to stop, but he remarked “chill, like just chill, no-one is going to know it is you”.

Despite her refusals, the victim was later forced into performing oral sex on Mack, and into having sexual intercourse without a condom.

The court heard Mack told the woman to keep quiet in case people would hear them and the incident stopped when a group of people arrived at the car park.

Society ‘impoverished’ by sexual objectification: judge

In a victim impact statement previously tendered to the court, the woman said she still feels “frozen” from the ordeal three years on.

“I couldn’t look at myself in the mirror without seeing the sickening writing that was tagged over my entire body as if I were a piece of property,” the woman said in the statement.

“The most painful moment of that night was excessively scrubbing my skin to erase the permanent marker from my chest to my knees.

“I scrubbed my skin for an hour until the marker was replaced by almost raw skin.”

When handing down the man’s sentence, Chief Justice Lucy McCallum told the court the woman now experienced symptoms of post-traumatic stress disorder and the experiences had caused “substantial harm”.

She said the offender labelled the victim’s body as if it were his possession or “conquests” and as though “it was his to tag and share”.

“He found this so hilarious, he couldn’t wait to show his mates,” the Chief Justice told the court.

“The offender, in effect, treated the victim, whom he had only met that night, as a piece of live pornography.

“Every time a woman is treated as a sexual object or labelled as the possession of a man, society is impoverished.”

Mack will be eligible for parole in May 2026.
